希腊永居新政
The Greek residence permit program is about to be improved as part of compliance of the Greek Immigration Code to the relevant European Directive 98/2011. Our proposals were appreciated by the ministry of interior and were incorporated in a new act expected to receive parliament’s approval by the end of June 2015. The parliament’s approval was eventually granted on 09.07.15

Most significant improvements are listed below:

• The investor and all descendants (children of both husband and spouse) under 21 years old, receive a “Permanent residence” and will have the rights of permanent residents in Greece, by renewing their initial 5year residence permits for additional 5year periods, as long as the property hold is maintained by the investor.
投资者以及所有后代(与配偶的子女),21周岁以下的子女,都将直接获得“永
久居留”,并且有权利在希腊合法居住,只要房产不出售,该居留许可为永久居
留许可,每5年一次更新。
• Staying or visiting Greece for a specified time during the period that the investor keeps hold of the property, is no longer a requirement for the renewal of the 5 year residency permit, which from now forms part of the 7 year citizenship requirement. In simple words as long as the investor holds the deeds of the property for a 7 year consecutive period, he is eligible to apply for citizenship.
• 每5年更新一次“永久居留许可”,不需要申请人入境希腊或者居住。同时在持有希腊永居7年可以申请希腊护照。简单归纳为:只要投资者持有房产7年,便可以申请希腊的护照。
• Greek citizenship is also granted to the children of both husband and spouse, provided that they are less than 18 years old at the date the investor is registered as a Greek citizen. The provision for a permanent residence permit for the children of the investor, until the age of 21st, remains in effect.
• 配偶双方任一一方只要拥有希腊国籍,其18周岁以下的子女直接可以加入希腊国籍。若不加入国籍,子女持有的居住许可仍然持续到21周岁。
• Parents of both husband and spouse will also receive a permanent residence permit as long as the property hold is maintained by the couple.
• 丈夫和妻子的双方父母,都可以直接拿到永久居留许可。
• The permanent residence permit acquired by an investor can be and will be <transferred> to another investor that agrees to purchase the property from the initial buyer, who in turn is deprived of his rights to the permit.
• 投资者购房后可以将房产出售给第三方,但是同时失去永居权利。

新政法律变动
Compliance of the Greek Immigration Code (Law 4251/2014) with EU Directive 98/2011 is pursued through additions, eliminations and amendments in the wording of Law 4251/2014 provisions.
该新政的法律编号为4251/2014,符合欧盟移民法98/2011,对法律4251/2014中的措辞进行修改,变动如下:
The article in concern is article 20 of Law 4251/2014 (third country nationals can obtain residence permit when investing in Greece), which is amended through Article 8 of the new Law as described below:
新政在法律中的变动为:法律4251/2014第20条(第三国身份在希腊买房投资可以获得居住许可)中的内容,对其第8款修改如下:
• Paragraph 3 of Art. 8 adds a paragraph stating that <periods of absence from the country do not prejudice the right of the investor to extend their permanent residence permit as long as they keep hold of the property>
• 新政中第8款第3段增加:只要投资者持有房产,不用入境或者居住要求,永久保持永居的身份。
• Paragraph 9 of Art. 8 amends the header of Chapter B of Article 20 introduces the term <permanent residence permit> to be issued from now on for the investors. A permanent residence permit holder is the only person eligible to apply after 7 years hold for citizenship under the general provisions of the amended Immigration Code.
• 新政中第8款的第9段代替以前的第20款第B章节,加入:只要投资者投资房产,直接拿到永久居留身份。而只要持有永久居留许可满7年,便可以申请加入希腊国籍。
• Paragraph 10 of Art. 8 award the parents of both husband and spouse the right to apply for permanent residence permit.
• 第8款的第10段:丈夫和妻子的双方父母同时可以拿永居。
• Paragraph 11 of Art. 8 introduces the right of an investor to <transfer> his permanent residence permit to another investor that agrees to purchase the property from the initial buyer, who in turn is deprived of his rights to the permit.
•第8款第11段:投资者有权利通过出售房产的方式,将其永久居留许可“转让”给另外一个投资者,但是同时会失去永居的身份。
